1. Definitions
- Service: PicTrix.ai website, applications, APIs, and related features.
- User Content: Prompts, uploads, and account-provided information.
- Generated Output: Images or other outputs generated by the Service from User Content.
- Account: Your registered profile and associated credentials.
2. Acceptance and Eligibility
By accessing or using the Service, you enter into these Terms with PicTrix.ai. You must be at least the age of majority in your jurisdiction, or use the Service with required guardian consent where applicable.
3. License and Acceptable Use
Subject to these Terms, we grant you a limited, revocable, non-exclusive license to use the Service. You must comply with our Community Guidelines and all applicable laws.
4. User Content and Generated Output
You represent that you have rights to submit your User Content. You retain rights in User Content and applicable rights in Generated Output, subject to third-party rights and applicable law.
You grant PicTrix.ai a worldwide, non-exclusive license to host, process, and transmit User Content and Generated Output solely to operate, secure, and improve the Service.
5. Subscription, Billing, and Payments
- Paid plans renew automatically according to the selected billing interval unless cancelled before renewal.
- Payments are processed by Stripe. You authorize recurring charges for active subscriptions.
- Prices may change with advance notice and apply to a future billing cycle.
- Applicable taxes may be added where required by law.
- Failed payments may result in temporary suspension or downgrade until payment is resolved.
6. Cancellation and Refunds
You may cancel at any time through account settings. Cancellation generally takes effect at the end of the current paid period.
Unless required by law, digital purchases are non-refundable once service access or credits have been provisioned.
7. Suspension and Termination
We may suspend or terminate accounts for security risks, non-payment, abuse, legal compliance requirements, or violations of these Terms. If you believe action was taken in error, you may request review via support.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the fullest extent permitted by law, PicTrix.ai is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or business interruption.
Where liability cannot be excluded, our aggregate liability for all claims related to the Service is limited to the greater of (a) amounts you paid to PicTrix.ai during the 12 months before the claim, or (b) CAD $100.
10. Force Majeure
PicTrix.ai is not responsible for delays or failures caused by events beyond reasonable control, including infrastructure outages, internet failures, labor disputes, natural disasters, or government actions.
11. Governing Law
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that disputes will be submitted to the courts located in Quebec, Canada, unless applicable law requires otherwise.
12. Changes to Terms
We may revise these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
